NOTICE OF FLUCTUATING RIVER LEVELS. ALL RIVER USERS should remember that fluctuating river flows occur daily and may change throughout the day. River flow may conceal or create natural hazards such as moving sandbars, gravel bars, unstable riverbanks, floating or submerged debris, or other unfamiliar obstacles. There is NO GUARANTEED MINIMUM DEPTH in the Laughlin Bay channel nor within the Marina due to the sedimentation that may follow seasonal rains and drainage into Laughlin Bay outside of the Marina. The Master of the vessel is responsible for operating the vessel in a safe and responsible manner at all times including becoming aware of and avoiding shoal areas that may occur due to fluctuation in river flow or changes in the contour or depth due to sedimentation. - ENVIRONMENTAL. Oil, oily water or raw or untreated sewage shall not be discharged into the water
or on land. All vessels shall be subject to inspection at any time by the Laughlin Bay Marina Management
Company (the “Management Company”) staff and other authorities to ensure that all sewage systems
are Coast Guard approved and all through-hull valves are properly sealed to prevent illegal dumping while
in port. No porta-potties are permitted in Laughlin Bay Marina (the “Marina”). Pump out facilities are
provided at the Marina. Boat owners and guests are encouraged to use the public restrooms shoreside.
Boats may only be washed with biodegradable soaps and the amount of soap used must be kept to a minimum. Removed paint chips, sanding debris, soaked rags, and hazardous chemicals, including oil, engine coolant, hydraulic fluid, gasoline, diesel, paint and mineral spirits may not be allowed to enter the water or the ground and may not be left where they might be prone to overturning or spilling or exposed to rainwater. Proper disposal of all such sewage, oil products and chemicals is the sole responsibility of the boat owner.
All spills of gas, diesel fuel, oil or other hazardous materials must be reported immediately to all governmental authorities, and the Management Company Manager. The Management Company office may be contacted for access to the Hazardous Materials Station at the Marina for approved disposal. The boat owner agrees to act in accordance with and follow the directions of the Harbor Master in all matters concerning disposal of hazardous wastes and liquid wastes including used oil and/or antifreeze.
TRASH. Garbage is not to be thrown overboard or stored on the docks or in the dry storage area. It must be placed in sealed plastic bags and placed in the dumpster provided. No oil products, paints, or solvents or other hazardous items are allowed in the trash. An oil disposal facility is provided at the Marina.
NOISE. Noise should be kept to a minimum at all times. Discretion in operating engines, generating plants, radios, televisions, other sound producing devices and other power equipment should be used so as not to create a nuisance or disturbance. No loud music or disturbances shall be allowed after 10:00 p.m. Except for entering or leaving the slip, main engines, power generating equipment or other noise making machinery shall not be operate between the hours of 10:00 p.m. and 8:00 a.m.
SWIMMING AND FISHING. Swimming, diving and fishing are not permitted from the docks or finger piers. A general public swimming beach is provided directly south of the Café/Administration building. Swimming is at your own risk and no life guard service is provided. Non-swimmers and children under the age of 16 are encouraged to wear life vests in and around the Marina and swimming beach. Large inflatables (floatation devices suitable for more than 2 persons) are not allowed on the swim beach.
STORAGE ON DOCKS. Walkways shall be kept clear at all times. Only approved dock boxes and boat stairs are allowed on the docks. Only dock boxes properly installed by the Marina may be used. Storage of items must be confined to the dock box or the boat and will not be permitted on the docks, finger piers, parking areas, etc. Any unapproved items found on a walkway or finger pier will be removed and disposed of at the owner’s expense. No hazardous liquids may be stored in the Marina dock boxes.
PARKING AND MOTOR VEHICLES. Designated parking is expressly for the use of Marina slip tenants and their guests on a first come first served basis. A daily parking fee applies to all vehicles at the Marina. Slip renters shall not be charged, but all guest vehicles will be charged to park. Violators will be towed at the owner’s sole risk and expense. Long-term storage of vehicles is not permitted. Vehicles shall not be left in the same spot for more that three days without approval. Laughlin Bay Marina does not warrant the availability or security of parking. The Management Company disclaims responsibility for vehicles parked in the parking lots, including damage to, theft of or theft from vehicles. No overnight accommodations will be allowed in a trailer, recreational vehicle or other camping equipment on the Marina property. Trailers or small boats on trailers are not to be parked in any parking area, without written approval from the Management Company. The parking areas are often congested with many pedestrians moving around; please drive very slowly through these areas to avoid accidents and injuries. Obey all traffic control signs and street markings.
FIRES, COOKING AND CAMPFIRES. No open fires or BBQ’s are permitted on the docks or on board while berthed in the Marina. Use of cooking stoves on board a berthed vessel is allowed provided that the owner must position a fire extinguisher outside of the galley and available for immediate use in the event of a fire. Boat owners will make themselves aware of the evacuation routes and the fire protection equipment available at the Marina and will follow the directions of the Harbor Master in all matters concerning fire safety procedures.
FIREWORKS. Absolutely no fireworks of any kind may be used or stored in the Marina.
PETS. Pets are permitted only if they do not create any disturbance. All pets must be kept on a leash. Pet owners are responsible to clean up debris left by their pets. Management Company reserves the right to bar any pet from the Marina.
- BOAT MAINTENANCE. Boat owners are allowed responsible latitude regarding the care and maintenance
of their boats. However, the following limits apply: Work above the rail or in the interior of the board
may be performed if it presents no hazard and does not interfere with other work in the immediate vicinity
being performed by Management Company employees or other boat owners, captains or crew. Other than
employees or approved subcontractors of the Marina, and approved subcontractors employed by Boat
Owners and registered in Marina, only boat owners or a boat owner’s employees who normally operate the
boat may perform work. Hull repairs, engine repairs/overhaul, any sanding and/or painting,
major carpentry/rebuilding projects will normally not be approved. No engine preventative
services including oil changes are allowed while the vessel is in the water. Any approved projects
must be accomplished strictly in compliance with all applicable laws and regulations; any violations will
cause immediate stoppage of work, and may lead to cancellation of project approval. Repairs that may
damage the docks are not allowed. Boat owners are liable for any damage to Marina property, which occurs
as a result of such repairs. At the end of the day, all tools, lumber, supplies, etc., shall be neatly stored
upon the vessel. Work areas shall be covered with tarps, in order to maintain a neat appearance. Work
items and debris shall not be left on docks or finger piers. Debris that results from repairs shall be removed
from Marina property by the boat owner. The dumpsters are not approved for repair debris of any sort.
Outside contractors must be registered with Management Company, provide proof of current sufficient liability
insurance and worker’s compensation insurance prior to commencement of work.
All boats shall be fitted with functioning bilge water filters if a bilge pump is installed on the vessel. Do not discharge unfiltered bilge water into the Lagoon at any time.
SEAWORTHY CONDITION OF BOAT. All boats are to be maintained in a sound and seaworthy condition. When this fails to occur and/or Management Company considers there to be a risk of sinking, fire or other hazard, the Management Company may, in its sole discretion, give the boat owner 30 days notice in writing in which to correct the problem(s). Failure to do so will be a DEFAULT in the terms of the License Agreement. The Management Company reserves the right to perform periodic vessel inspections to determine the seaworthiness of any vessel.
LAUNDRY. Laundry shall not be hung on boats or docks.
ELECTRICAL. All connections made to the Marina receptacles must be U.L. approved, marine-type. Wiring must be of adequate size for power provided. This determination is the boat owner’s sole responsibility and duty and the boar owner assumes all risks therefore. Cords are not allowed to cross the top of walkways. No alterations or modifications to any electrical outlet used for servicing a boat with shore power shall be made. Plugs must match the receptacle used. Until further notice, no electrical connections are provided or permitted in the Marina.
WEAPONS. No weapons or shooting of any kind are permitted on Marina premises.
SLIP AREA. No portion of a boat (i.e. hull, bowsprit, plank, bow pulpit, etc.) shall over-hang the walkway at any time nor extend into the waterway more than three feet unless approved in writing by the Management Company. Private gangways will not be allowed to block access to another vessel. Boarding steps and ladders are subject to approval by the Management Company. Boat owners shall keep their slip free from clutter and debris.
WAKE. No wake allowed! Boat owners are responsible for damages caused by their boat’s wake regardless of compliance with posted speed limits.
MOORING LINES. Boat owners shall provide and maintain appropriate sized mooring lines in good working order and condition and will be responsible for tying up their boat so as not to damage other boats or property including the dock. If Management Company employees have to retie a boat at any time, due to poor mooring lines, there will be a labor and material charge assessed against the boat owner.
LIVE-ABOARDS. Occupying a vessel more than five consecutive days, or more than 14 days in any 30 day period is considered residential use and is strictly prohibited unless approved in writing by the Management Company. The License Agreement is specific regarding approval.
WALKS. Do not run on walkways of dock areas. Deck shoes are suggested for your safety. If water or mooring lines, or any other thing is required to cross a dock, it must be routed underneath or in a recessed area so as not to present a tripping hazard. Water hoses may be connected to spigots only when being used.
FUEL. Personal fueling of boats (carrying fuel in gas cans, etc.) is not allowed within the Marina. Storage of gasoline, fuel, or other combustibles on the docks is strictly forbidden.
CHILDREN. Children under 12 years of age are not permitted on the docks without a parent or responsible adult in attendance. Non-swimmers and young children are requested to wear life jackets when on docks or watercraft decks.
BICYCLES, ETC. The use of motorcycles, motor scooters, foot scooters, skateboards, roller blades, skates, and bicycles is not permitted on Marina docks or upon the Boardwalk fronting the Marina. Bicycles may not be parked or chained to any marina fence, light post, gate or other fixed structure.
COMMERCIAL ACTIVITY. No commercial activity shall be conducted at the Marina, without the written approval of the Management Company. Commercial activities include, but are not limited to, rental or leasing of boats, chartering of boats, use of the Marina address, use of a number of a telephone or facsimile on a boat in any advertising, brochure, letterhead, business card, or other commercial document. No advertising or soliciting is permitted in the Marina. The display of “FOR SALE” signs on a boat is not permitted without Management Company approval.
DOCK CARTS. Dock carts are provided for your convenience. Please leave the carts in a clean condition and return them to the gangway after use.
GATES AND KEYS. Security gates shall remain locked and closed at all times. Keys for the gates and restrooms are provided to all tenants at the beginning of tenancy. A security deposit will be required for all keys issued. Non-slip holders and persons without keys shall not be permitted access to the Marina docks and dry storage areas.
CLUBHOUSE ACCESS AND USE. Upon application and approval, Slip and Dry Storage renters may use the Clubhouse facilities including the swimming pool, Jacuzzi pool, sauna, workout and shower facilities. A monthly service fee applies and is non-transferable. Guests of Slip and Dry Storage renters may be allowed depending upon the demands of the facility and member use. A daily fee applies to all guests and an access pass may be obtained at the Marina office.
NO SOLICITING OR SCAVENGING is allowed in any area of the Marina. This includes the scavenging and/or collection of cans, bottles, and other recyclable materials from any containers or areas within the property and dock areas of Laughlin Bay Marina. Such actions or trespass shall be grounds for immediate eviction from the property of Laughlin Bay Marina at the sole discretion of Management Company.
MONETARY FINES FOR RULE VIOLATIONS may be imposed by the Management Company. Written warnings or notices of rule or contract term violations will result in the following fines and charges to storage accounts.
1st Violation – Warning
2nd Violation –$75 Fine
3rd Violation - $150 Fine
4th Violation - $300 FineOTHER. The rules of the Management Company and Marina are subject to change and may be amended from time to time as deemed necessary by the Management Company.
